Proposed Draft Local Evironmental Plan

The Sutherland Shire Council are currently preparing a draft LEP, in compliance with the Stndard Instrument (Local Environmental Plans) Order 2006, to replance the exisitng LEP 2006.

The draft plan will first be forwarded to the Department of Planing and infrastructure to be assessed against the "gateway" principles, prior to the draft being placed on public exhibition.

It is expected, providing the "gateway" principles, prior to the draft being placed on public exhibition for a period of 30-60 days. commencing in mid to late January 2012.

Once the draft LEP is placed on public exhibition, the community and other interested stakeholders will have an opportunity to make submissions on the draft.  This opportunity should not be passed over.  The commuity will have a singular chance to make submissions on important aspects of the draft dealing with such controversial planning matters as subdivisions, dual occupancies, the controls restricting dual occupancies on battleaxe allotments and all forms of development on waterfront properties.

The current stringent restrictions in the LEP 2006 for developments affecting waterfront propertiesd should be open for debate.

The equally contentious subject of surveillance cameras could be addressed in submissions to the draft LEP.

Although the draft exhibition miche seem a long way off, interested parties shold consider forming "interest groups" sooner rather than later with the view to obtaining professional advice to assist in the preparation of submissions to the draft LEP.

It is most important to bear in mind once the draft LEP has been gazetted the community will be bound by the contents and controls within the LEP.  All future development applications will be bound by the new LEP.

If you seek further advice on the draft LEP please contact Brian Phillips on 9589 6666 or email mcw@mcwlaw.com.au.
